Thomas & Company Solutions is a credit services organization as defined by federal and state law. We do not guarantee specific results or credit score improvements. Results vary based on individual circumstances. These Terms of Service constitute a binding legal agreement between you and Thomas & Company Solutions.
1. Acceptance of Terms
By accessing our website, scheduling a consultation, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, please do not use our website or services.
2. Services Provided
Thomas & Company Solutions provides credit literacy education and assistance services, including but not limited to:
- Education about rights under the Fair Credit Reporting Act (FCRA)
- Assistance in reviewing credit reports for inaccurate, incomplete, or unverifiable information
- Guidance on challenging credit report items through factual and Metro 2 challenging methods
- Financial literacy education and credit management strategies
- Support in working toward regaining financial standing
Important: We are not a law firm and do not provide legal advice. With your written authorization via Limited Power of Attorney, we may communicate and negotiate with creditors and credit bureaus on your behalf. We provide educational services and professional representation to help you understand and exercise your consumer rights under federal law.
3. Credit Repair Organizations Act (CROA) Disclosures
As required by federal law, we provide the following disclosures:
Consumer Credit File Rights: You have the right to dispute inaccurate information in your credit report by contacting the credit reporting agency directly (Equifax, Experian, TransUnion).
Free Services: You may obtain a free copy of your credit report annually from each credit bureau at AnnualCreditReport.com or by calling 1-877-322-8228.
No Advance Payment: Under CROA, we cannot require payment before services are fully performed.
No Guarantees: We cannot guarantee any specific results, credit score improvements, or timeline for outcomes. Results depend on many factors including the accuracy of information, credit bureau responses, and individual circumstances.
Written Contract Required: Any paid services will be governed by a written contract that complies with all CROA requirements, including cancellation rights.
4. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding agreements
- Provide accurate and complete information
- Reside in the United States
- Agree to comply with all applicable laws and regulations
5. Client Responsibilities
As a client, you agree to:
- Provide truthful, accurate, and complete information about your credit and financial situation
- Review your credit reports and identify items you believe are inaccurate, incomplete, or unverifiable
- Respond promptly to requests for information or documentation
- Follow our guidance and recommendations in good faith
- Notify us immediately of any changes to your contact information
- Not use our services for any unlawful or fraudulent purpose
- Not misrepresent information to credit bureaus or creditors
Our Challenge Approach:
You hire us to challenge the certification, reportability, and accuracy of how items are reported on your credit reports. Under the FCRA, credit bureaus must report information with 100% accuracy or delete it. We challenge:
- Technical accuracy of reporting (spelling, dates, amounts, status codes)
- Metro 2 compliance and proper certification
- Verification and documentation requirements
- Reportability under FCRA guidelines
Example: We don't dispute that a bankruptcy occurred, but we challenge whether it's being reported with the exact accuracy required by law. The burden of proof is on the credit bureaus to verify 100% accuracy of the reporting. What is prohibited: fraudulent misrepresentation of facts to deceive creditors or bureaus.
6. Consultation Process
Our free initial consultation includes:
- Review of your credit situation and concerns
- Education about your rights under the FCRA
- Discussion of potential strategies and approaches
- Explanation of our services and processes
- No obligation to proceed with paid services
Consultations are scheduled through our Zoom Scheduler and conducted via video conference. By scheduling a consultation, you consent to the recording of the session for quality assurance and training purposes.
7. No Guarantees or Warranties
We expressly disclaim any guarantees or warranties regarding:
- Specific credit score improvements or increases
- Removal of accurate negative items from credit reports
- Timeline for credit bureau responses or outcomes
- Approval for loans, credit cards, or other financial products
- Future creditworthiness or lending decisions
Results vary significantly based on individual circumstances, the accuracy of challenged information, credit bureau responses, creditor cooperation, and numerous other factors beyond our control.
8. Limitation of Liability
To the fullest extent permitted by law:
- Thomas & Company Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
- Our total liability for any claims shall not exceed the amount paid by you for our services in the 12 months preceding the claim
- We are not responsible for actions or inactions of credit bureaus, creditors, or other third parties
- We are not liable for any credit decisions made by lenders or financial institutions
- We are not responsible for technical issues, website downtime, or data loss beyond our reasonable control
9. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of Thomas & Company Solutions or its licensors and is protected by copyright and intellectual property laws.
You may not:
- Copy, reproduce, or distribute our content without written permission
- Use our trademarks, logos, or branding without authorization
- Modify, reverse engineer, or create derivative works from our materials
- Use automated systems to scrape or extract data from our website
10. Confidentiality
We maintain strict confidentiality of all client information in accordance with FCRA requirements and our Privacy Policy. However, you acknowledge that:
- We may be required to disclose information pursuant to legal process or government requests
- Information may be shared with service providers necessary to deliver our services
- Anonymized, aggregated data may be used for statistical or business purposes
11. Termination
Your Rights: You may terminate our services at any time by providing written notice. If you are a client with a service agreement, cancellation terms will be governed by that agreement and CROA requirements.
Our Rights: We reserve the right to terminate or suspend services if you:
- Violate these Terms of Service
- Provide false or misleading information
- Engage in fraudulent or illegal activities
- Fail to cooperate or respond to reasonable requests
- Abuse, harass, or threaten our staff
12. Dispute Resolution

Arbitration: Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Alabama.
Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Alabama and the United States, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Alabama.
14. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. Changes to Terms of Service
We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Material changes will be communicated via:

- Email notification to active clients
- Updated "Effective Date" at the top of this page
Your continued use of our services after changes constitutes acceptance of the modified terms.
